Successful outcome to our UK-IPO "Request for opinion as to infringement" of UK Patent 2307574B

On June 10 2009 the UK Intellectual Property Office published its determination in response to a request for opinion re infringement in regard to Microsoft’s Office 2007 product and UK Patent GB2307574.

On the last page of the 18 page document available on http://www.ipo.gov.uk/pro-types/pro-patent/pro-p-dispute/pro-p-opinion-advert.htm (see item 08/09) the examiner concludes:

"I therefore conclude that the supply of Microsoft Office 2007™ constitutes an infringement of claims 1, 21, 22 and 23 of the patent within the meaning of section 60(2) of the Act."

 

Dolphin Software Pty Ltd (Australia) previously lodged a ‘Request for opinion as to validity or infringement’ (Patents Act 1977 (Rule 93)) in regard to what Dolphin Software believed to be a clear infringment of its UK Patent 2307574B.

A copy of Dolphin Software's submitted UKPO Form 17 and other documentary evidence referenced by the Form 17 submission is (now) available for access - but only on Dolphin Software's UK based web-site.

As Microsoft is a US based corporation with international offcies this information will specifically not be available on Dolphin Software's US or Australian web-sites, as the publishing of any documentary evidence on these sites would most likely not be protected by the existence of the UK Patents Act 1977.
